El artículo aborda la responsabilidad médica penal por omisión en situaciones de emergencia de salud, debido a las dudas que aún existen sobre el accionar médico en estas circunstancias y las posibles consecuencias jurídicas por negligencia, impericia e imprudencia. La responsabilidad médica incluye la obligación moral de responder de los propios actos y reparar o indemnizar las consecuencias perjudiciales para terceros. Se identifican las falencias en las normativas ecuatorianas con relación al actuar médico en situaciones de emergencia de salud y (...) se busca aportar a la academia con publicaciones de conocimiento. Se analizan los elementos normativos y fácticos de la responsabilidad médica penal por omisión en situaciones de emergencia de salud en la República de Ecuador, y se busca identificar el marco normativo en la legislación ecuatoriana para superar la inadecuada actuación médica en estas situaciones. El conocimiento de la normativa legal contribuye a superar la responsabilidad médica penal por omisión en situaciones de emergencia en el Ecuador y se menciona y se analiza el art.146 del COIP que es la normativa vigente. El artículo concluye que el objetivo no es criminalizar la práctica médica, ya que no toda muerte es homicidio y no todo proceso judicial implica el encarcelamiento de los involucrados. (shrink)

Background Q-CEP (Qualificação dos Comitês de Ética em Pesquisa que compõem o Sistema CEP/Conep) is a nationwide project resulting from a partnership between the Brazilian National Research Ethics Commission (Conep), the Ministry of Health and Hospital Moinhos de Vento (HMV). It was developed to consolidate policy for ethical review of research with human beings in all members of the CEP/Conep System, Brazil’s national system of institutional review boards. The aim of this study was therefore to report on the experience and (...) results of the Q-CEP project. Methods An observational, retrospective study includes data from the Q-CEP, obtained from visits to all the institutional research ethics committees (RECs) in the country. The actions implemented by Q-CEP were part of a two-step process: (i) training visits to each REC; (ii) development of distance learning modules on strategic topics pertaining to research ethics evaluation. The data presented herein cover step one (training visits), defined by Q-CEP as the diagnostic stage of the project. For a country with social and economics inequalities such as Brazil, this is a particularly important stage; an accurate picture of reality is needed to inform planning of quality improvement strategies. Results In 2019–2021, Q-CEP visited 832 RECs and trained 11,197 people. This sample covered almost all active RECs in the country; only 4 (0.5%) were not evaluated. Of the 94 items evaluated, 62% did not reach the target of at least 80% compliance and around 1/4 (26%) were below 50% compliance. The diagnostic stage of the process revealed inadequacies on the part of the RECs in their ethical reviews. The analysis of informed consent forms showed compliance in only 131 RECs (15.74%). The description of pending issues made by RECs in their reports was compliant in 19.33% (n = 161). Administrative and operational aspects were also considered inadequate by more than half of the RECs. Conclusions Overall, Brazilian RECs showed poor compliance in several aspects of their operation, both in ethics evaluation and in other processes, which justifies additional training. The Q-CEP project is part of a quality improvement policy promoted by the Brazilian Ministry of Health. The data obtained in the diagnostic step of the project have contributed to the qualification and consolidation of one of the world’s largest research ethics evaluation systems. (shrink)

This paper introduces a novel perspective on Agentive Cognitive Construction Grammar (AgCCxG) by examining the intricate interplay between mind and language through the lens of both Active Inference and Peircean semiotics. AgCCxG emphasizes the impact of intention and purpose on linguistic choices as a cognitive imperative to balance the symbolic Self (Intelligent Agent) with the dynamics of the environment. Among other things, the paper posits that linguistic constructions, particularly Constructional Attachment Patterns (CAPs), like argument structure constructions, embody experienced interactions with (...) the world through reenactment routines via the integration of multisensory channels. Unlike traditional usage-based approaches (e.g., construction grammars), AgCCxG embraces a robust theory of signs that reveals human representation as a continuous process of semiotic hybridization for the creative prediction of uncertain scenarios. Importantly, the paper challenges the notion of the mind as a unified, rational, uncertainty-reducing machine by asserting that physical processes governing open biological systems profoundly influence the linguistic sign system. Intelligent agents’ adaptability in expressing incongruous realities thus highlights the role of semiotic hybridization in preserving an agent’s autonomy and semiotic boundary. (shrink)

En el presente artículo se analiza el relato sobre la supuesta correspondencia mantenida por Jesús y el rey Abgar V de Edesa, presente en la obra Historia Eclesiástica de Eusebio de Cesarea. Desde sus inicios, la leyenda gozó de mucha fama debido a la consideración de los fieles de que se trataba de uno de los pocos testimonios existentes sobre un texto escrito por el mismísimo Jesús. Este hecho provocó que esta tradición se tradujese a numerosas lenguas y recibiera varias (...) influencias distintas, lo que sin duda favoreció su desarrollo y su pervivencia en el tiempo. A pesar de los numerosos estudios sobre su popularidad y sobre las distintas versiones existentes, el origen de esta leyenda sigue sin estar claro y está lejos de llegar a un consenso académico. Por tanto, en este trabajo se estudian las distintas perspectivas sobre el inicio de esta tradición, analizando aquellas teorías que se centran en sugerir que la obra se trata de una invención del autor, pero también buscando algún matiz histórico que pudo servir como fuente de inspiración para Eusebio de Cesarea. Cancer is a singular cellular state, the emergence of which destabilises the homeostasis reached through the evolution to multicellularity. We present the idea that the onset of the cellular disobedience to the metazoan functional and structural architecture, known as the cancer phenotype, is triggered by changes in the cell's external environment that occur with ageing: what ensues is a breach of the social contract of multicellular life characteristic of metazoans. By integrating old ideas with new evidence, we propose that with (...) ageing the environmental information that maintains a multicellular organisation is eroded, rewiring internal processes of the cell, and resulting in an internal shift towards an ancestral condition resulting in the pseudo‐multicellular cancer phenotype. Once that phenotype emerges, a new local social contract is built, different from the homeostatic one, leading to tumour formation and the foundation of a novel local ecosystem. (shrink)

The present paper introduces and studies the variety WH of weakly Heyting algebras. It corresponds to the strict implication fragment of the normal modal logic K which is also known as the subintuitionistic local consequence of the class of all Kripke models. The tools developed in the paper can be applied to the study of the subvarieties of WH; among them are the varieties determined by the strict implication fragments of normal modal logics as well as varieties that do not (...) arise in this way as the variety of Basic algebras or the variety of Heyting algebras. Apart from WH itself the paper studies the subvarieties of WH that naturally correspond to subintuitionistic logics, namely the variety of R-weakly Heyting algebras, the variety of T-weakly Heyting algebras and the varieties of Basic algebras and subresiduated lattices. The speaking, saying and knowing subject, based on contexts and the principles of congruency and trust in the speech of other speakers, will create meanings and interpret the sense of utterances supplying the deficiencies of language by means of the intellective operations mentally executed in the act of speech. Linguistics of saying studies language in its birth. Language is the mental activity executed by speaking subjects. Linguistics of saying consists in analyzing speech acts as the result of an act of knowing. Speaking subjects speak because they have something to say. Tthey say because they define themselves before the circumstance they are in. And this is possible because they are able to know. Speaking, then, is speaking, saying and knowing. In this sense there is a progressive determination. Knowing makes (...) possible saying, and saying determines speaking, or, in other words: speaking involves saying and knowing, and saying involves knowing. The problem thus is to determine the meaningful intentional purpose of the individual speaker to say something in every speech act. (shrink)

Ethical concerns of Internet users continue to rise. Accordingly, several scholars have called for systematic empirical research to address these issues. This study examines the conceptualization and measurement of consumers' perceptions regarding the ethics of online retailers. Also, this research represents a first step into the analysis of the relationship between CPEOR, consumers' general Internet expertise and reported positive word of mouth. Results, from a convenience sample of 357 online shoppers, suggest that CPEOR can be operationalized as a second-order construct (...) composed of four dimensions: security, privacy, fulfillment, and non-deception. Our findings also indicate that consumers' general Internet expertise significantly improves CPEOR and CPEOR are strongly predictive of consumers' WOM. En este artículo se plantea una reconsideración de la elección del reduccionismo de Parfit en Razones y personas como la posición que mejor explica el vínculo de dos sucesos mentales separados en el tiempo. Sin embargo, veremos cómo Parfit basa dicha elección en la consideración de la noción de persona como una sustancia, lo que en principio deja fuera cualquier otra perspectiva. El problema aparece cuando éste no considera apropiadamente el origen histórico de la pregunta en Locke, donde la noción (...) de “persona” se caracteriza en función de la “conciencia de sí”, lo que abre la posibilidad de entender dicha noción a partir de su naturaleza modal en vez de sustancial. En esta medida, se verá cómo esta tercera alternativa incluye una explicación de la conciencia de sí que podría considerarse más razonable bajo los propios términos de Parfit. (shrink)

La “conservación de la salud” ha constituido el eje sobre el que se han articulado y evaluado las aportaciones de Descartes a la medicina. Sobre ello, las interpretaciones canónicas se han circunscrito a la terapéutica cartesiana para las enfermedades, obviando otras dimensiones a las que el proyecto médico cartesiano también se dirigió. De ese modo, el presente artículo aborda un segundo sentido de conservación de la salud entendido como “preservación de la salud”, dirigiéndose, para ello, a un análisis de la (...) dieta cartesiana, cuyo empleo evita, según Descartes, la contracción de distintas afecciones. Dicho examen trata de mostrar en qué sentido la dieta posibilita la preservación de la salud, y cómo ésta se justifica apelando a la propia fisiología cartesiana. (shrink)

Tarski algebras, also known as implication algebras or semi-boolean algebras, are the \-subreducts of Boolean algebras. In this paper we shall introduce and study the complete and atomic Tarski algebras. We shall prove a duality between the complete and atomic Tarski algebras and the class of covering Tarski sets, i.e., structures \, where X is a non-empty set and \ is non-empty family of subsets of X such that \. This duality is a generalization of the known duality between sets (...) and complete and atomic Boolean algebras. We shall also analize the case of complete and atomic Tarski algebras endowed with a complete modal operator, and we will prove a duality for these algebras. (shrink)

En este trabajo se estudia la primera concepción escotista sobre las categorías y sobre el objeto del tratado aristotélico de las Categorías. El artículo se concentra sobre las tres primeras cuestiones del comentario de Duns Escoto al texto de Aristóteles. Una de las novedades del texto es su tematización del concepto mismo de categoría, entendido como concepto lógico y como objeto propio del tratado aristotélico. Esta aproximación permite a Escoto distinguir el orden lógico y el orden metafísico en el tratamiento (...) de las categorías. En el primero, la lógica se ocupa del concepto de categoría y, en el segundo, la metafísica se ocupa de la diversidad categorial y de su referencia a la categoría de la substancia. (shrink)

Language is nothing but human subjects in as much as they speak, say and know. Language is something coming from the inside of the speaking subject manifest in the intentional meaningful purpose of the individual speaker. A language, on the contrary, is something coming from the outside, from the speech community, something offered to the speaking subject from the tradition in the technique of speaking. The speech act is the performance of an intuition by the subject, both individual and social.

The creation of a citizen militia is a characteristic pretension of the Renaissance republicanism. The republic cannot lack defense nor defend themselves with mercenary armies. For Machiavelli, Guicciardini or Giannotti the citizen has a set of virtues, like austerity, discipline, patriotism or bravery, that make him the best soldier. Therefore, the Republican regime needs the citizens to be soldiers, because the military discipline itself is a means necessary to forge such civic virtues without which no republic can survive.

La resolución 466 de 2007, promulgada por el Ministerio de Educación Nacional, representa un avatar sin precedentes en la institucionalización de la Ciencia Política en Colombia. Aunque avanza en la definición de las características específicas de calidad y desarrollo de los programas en materia de metodología, sin embargo no logra establecer una diferenciación clara entre los programas de ciencias sociales. Por esta razón, el presente artículo indaga por la especificidad disciplinar de la Ciencia Política, a partir de la revisión de (...) los métodos de investigación, en los programas de pregrado de las universidades de Bogotá. Para este efecto, está dividido en dos partes: primero, una revisión de la discusión epistemológica sobre los métodos de la disciplina en Francia e Inglaterra; y segundo, una revisión de los contenidos y la bibliografía de los syllabus de metodología de los programas de ciencias sociales de las universidades de Bogotá. Al final, se espera demostrar que no existen métodos específicos de Ciencia Política sino métodos genéricos para las ciencias sociales. (shrink)

The determining role that tool development plays in neuroscientific progress poses special challenges to the Kuhnian-rooted philosophy of scientific change. Some philosophers of neuroscience argue that revolutions in neuroscience do not involve paradigm shifts, but instead depend exclusively on technical or experimental innovation. By studying the historical episode of the discovery of the neuron (1873-1909), I argue that revolutions in neuroscience, like many other laboratory revolutions, are frequently driven by the intertwining of technical innovations and conceptual change.

The objective of this paper is to identify, from a historical perspective, the presence of elements of the protagorean thought in the Herodotus’ Histories. I realize an analysis of the passages in which Herodotus refers to νόμος and φύσις, which constitute a conceptual antithesis within the framework of the fifth century a.C. From this analysis I will try to show that Herodotus retakes the intellectual discussions of the fifth century BC, but makes a controversial reception of these concepts highlighting the (...) climate of conflict on the level of the symbolic. Este artículo presenta las principales constataciones del informe "La situación social de los inmigrantes acompañados por Cáritas", trabajo de investigación elaborado por el Observatorio de la Realidad Social de Cáritas, con la información recibida de las 54 Cáritas Diocesanas (CCDD) que participaron en el estudio y que representan un 80 % de la Confederación de Cáritas Española.

En Representaciones mentales, Liza Skidelsky se propone poner de manifiesto la completa escisión que existe entre los fenómenos de la intencionalidad de los estados mentales y el contenido de las representaciones mentales. Por un lado, la autora defiende una elucidación internista del contenido de las representaciones mentales postuladas por la ciencia cognitiva. Por otro lado, nos propone concebir la intencionalidad como un fenómeno vinculado al lenguaje y a las prácticas comunicativas. Esta reformulación permitiría establecer los cimientos para un proyecto naturalista (...) ampliado, según el cual las ciencias humanas y sociales ofrecerían el marco interdisciplinario adecuado para la explicación de la intencionalidad. En esta nota crítica, sostengo que el proyecto naturalista cientificista todavía cuenta con algunos recursos conceptuales, provenientes de la neurociencia cognitiva y de la neurociencia computacional, que pueden eventualmente saldar la brecha entre la representación y la intencionalidad.
